Q.1. Discuss the salient features of FEMA and elaborate on the difference between FERA and FEMA. (Features of FEMA, difference) 4,6
ANS: Features of FEMA: we will discuss the Foreign Exchange Management Act (FEMA) of 1999. The Act came into existence on June 1, 2000 replacing the Foreign Exchange Regulation Act (FERA) of 1973.

·         The FEMA replaced FERA, as the latter was inadequate to deal with the consequences of the post-liberalisation policies introduced in India. However, FEMA maintained and promoted an orderly development foreign exchange market in India.

ANS:  Incoterms:  When parties agree on transportation arrangements it is a good idea to make use of Incoterms. This is a document published by the International Chamber of Commerce ('ICC') in an attempt to standardise the meaning of the terms describing different types of agreements. The most recent edition is called Incoterms 2000 and parties to a contract are free to adopt 'Incoterms 2000' as part of their contract by expressly including the terms into the wording of the contract. Four groups of contracts can be found under Incoterms 2000:

ANS: Rights of an unpaid seller: According to Section 45, a seller of goods is deemed to be an ‘unpaid seller under the following circumstances:

·         When a bill of exchange or other negotiable instrument has been received as conditional payment and the condition on which it was received has not been fulfilled by reason of dishonour of the instrument.
